1. Introductory provisions
1.1. These Terms of Use (the “Terms”) govern the rights and obligations associated with using the ComGuide online educational service, comprising the account and course website available at portal.comguide.cz and the connected realtime training environment (the “Portal”).
1.2. The Portal is operated by ComGuide a.s., with its registered office at Libečkova 252/1, Řeporyje, 155 00 Prague 5, Company ID No. 178 51 319, registered in the Commercial Register maintained by the Municipal Court in Prague under file No. B 27795 (the “Operator”, “we” or “us”).

1.4. For the purposes of these Terms:
- “User” (or “you”) means an individual who has created a user account on the Portal;
- “Customer” means an organisation that ordered and paid for a User’s access to a Course and provided the registration link;
- “Course” means educational content on the Portal, particularly training situations involving a virtual patient or another virtual character (avatar);
- “Licence” means the right of one User to complete one Course.
2. Registration and user account
2.1. You create an account through a link provided by the Customer or directly by the Operator. By registering and selecting the relevant checkbox, you confirm that you have read and agree to these Terms.
2.2. You must provide truthful and current information. Your account is personal and non-transferable. You must not allow another person to use it or share your login credentials.
2.3. You must protect your password. You are responsible for activity performed through your account unless it demonstrably occurred without your fault after you reported misuse.
2.4. Each person may have only one account. We may merge or cancel duplicate accounts.
3. Licence and permitted use
3.1. Access to a Course is based on a Licence usually paid for by the Customer. As a User, you do not pay for using the Portal unless you purchased access yourself.
3.2. The Licence is non-exclusive, non-transferable and time-limited. It lasts for the period agreed with the Customer or, otherwise, while the Course remains available on the Portal.
3.3. You may use the Portal only for your own education. In particular, you must not:
- make your account or Course content available to third parties;
- record Course content, including screen recordings or text copies, and distribute it;
- use the Portal in a way that may damage, overload or restrict its operation;
- circumvent technical measures, reverse engineer the Portal or attempt to obtain its source code;
- access the Portal using automated means such as bots or scrapers;
- use the Portal for purposes other than education, particularly to test or develop competing products.
4. Nature of the service and AI-generated content
4.1. The Portal is an educational simulation. Virtual characters are powered by artificial intelligence and their responses are generated automatically in real time.
4.2. All training situations and characters are fictional. Any resemblance to actual persons is coincidental.
4.3. AI-generated content may be inaccurate, incomplete or unexpected. Portal content, including automated feedback, is not medical, psychological or other professional advice and does not replace professional education, clinical practice or supervision.
4.4. Training difficult communication situations may be emotionally demanding. You may leave the Portal at any time and return later.
5. Your conversation input
5.1. During training, you communicate with the avatar by voice or text. Your live audio stream is transmitted to the AI providers used for the conversation solely to process the conversation and produce a machine transcription. Provider accounts are configured without persistence and without using the content for AI training. ComGuide does not store an audio recording; it retains only the text transcript. Further details are provided in the Privacy Notice.
5.2. Do not enter real personal data about patients, clients or other people into conversations with the avatar, including names, diagnoses or national identification numbers. Training uses fictional situations and real third-party data does not belong in it. You are responsible for the content you enter.
6. Intellectual property
6.1. All Portal content, particularly training situations, methodology, texts, graphics, avatars and software, is protected by the intellectual-property rights of the Operator or its licensors.
6.2. Apart from the right to use the Portal under these Terms, you acquire no rights to its content.
7. Availability and changes
7.1. We make reasonable efforts to keep the Portal continuously available but do not guarantee uninterrupted or error-free availability. Temporary outages may occur due to maintenance, updates or third-party failures.
7.2. We may change, add or remove Portal functions and content to improve the service. We will inform you or the Customer about material changes that restrict access to an ongoing Course.
8. Ending use
8.1. You may cancel your account at any time by contacting the address in section 1.3.
8.2. The Operator may suspend or cancel an account if the User materially breaches these Terms, particularly sections 2.2, 3.3 or 5.2, after prior warning or immediately where serious harm is threatened.
8.3. Ending use does not affect provisions that by their nature continue to apply, particularly sections 6 and 9.
9. Liability
9.1. The Portal is provided “as is”. To the extent permitted by law, we are not liable for harm resulting from Portal unavailability, inaccurate AI-generated content, or use contrary to these Terms.
9.2. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
10. Personal data protection
10.1. Information about the personal data we process, our purposes, recipients and your rights is available in the separate Privacy Notice.
11. Final provisions
11.1. These Terms and the legal relationships arising from them are governed by Czech law. Czech courts have jurisdiction, without affecting consumer rights under the laws of the consumer’s country of habitual residence.
11.2. We may reasonably amend these Terms, particularly following changes in law, Portal functions or the business model. We will publish the new version on the Portal and notify you of material changes by email or at login. If you disagree, you may cancel your account under section 8.1.
11.3. If any provision is or becomes invalid, the remaining provisions remain valid.
11.4. These Terms are available in Czech, English and German. If the language versions conflict, the Czech version prevails.
